Terms of Service & Sale

1. Purpose

These Terms of Service and Sale (Conditions Générales de Vente et d'Utilisation) govern access to and use of the FlirtIA service, an artificial-intelligence conversation assistant designed to help its users in their romantic exchanges, available on mobile apps (iOS, Android) and on the web at app.flirtia.fr. By creating an account or using the service, you accept these terms without reservation.

2. Access to the service

FlirtIA is restricted to people aged 18 or over. Access to the main features (generated replies, screenshot analysis, partner profile) requires an active subscription. The PRO weekly plan starts with a 3-day free trial, which you can cancel at any time at no cost. An anonymous account is created automatically the first time you launch the app; you can link an email address to it to secure it.

3. Subscriptions and prices

FlirtIA offers two subscriptions, each available weekly, monthly or yearly. PRO costs €2.99 per week, €8.99 per month or €59.99 per year. Only the PRO weekly plan is preceded by a 3-day free trial period; no amount is charged during this trial. PRO notably includes 40 generations, 7 screenshot analyses and 12 date tips per day, with counters reset every night at midnight. Premium costs €4.99 per week, €14.99 per month or €99.99 per year; it notably raises these caps to 100 generations, 12 screenshot analyses and 18 date tips per day, and unlocks the “Very Bold” model (spice level 5). This level offers suggestions with a more direct and confident tone, which some users may find too forward. It is never enabled by default: the Premium user must select it themselves. Like every level, it remains subject to FlirtIA's content rules, which exclude any crude or sexually explicit language, any description of sexual acts, and any romantic suggestion when the other person appears to be a minor. Each subscription renews automatically for the chosen period until it is cancelled.

4. Payment

Payments are processed exclusively by the App Store (Apple) or Google Play (Google) depending on your device, or by Stripe for the web version. FlirtIA does not collect or store any banking data. Displayed prices include all taxes. These providers may apply their own billing terms.

5. Right of withdrawal

In accordance with Article L221-28 of the French Consumer Code (Code de la consommation), the right of withdrawal cannot be exercised for digital content supplied immediately after purchase with your express consent. However, the 3-day free trial period lets you test the service and cancel at no cost before any charge is made.

6. Cancellation

You can cancel your subscription at any time from your App Store settings (iPhone), from Google Play (Android), or from your online billing area for the web version. Cancellation takes effect at the end of the current billing period; no prorated refund is given for the period already started. FlirtIA cannot cancel the subscription on your behalf.

7. Acceptable use

You agree to use FlirtIA respectfully and in compliance with the law. The following are notably prohibited: harassment, impersonation, using the suggestions for malicious manipulation or deception, and any attempt to circumvent the technical limits of the service. FlirtIA reserves the right to suspend an account in the event of abuse.

8. Nature of the service and liability

FlirtIA provides suggestions generated by artificial intelligence for guidance purposes only. These suggestions do not constitute professional advice and their relevance is not guaranteed. You remain solely responsible for the messages you send and for your interactions. FlirtIA cannot be held liable for the consequences of using the suggestions, nor for temporary interruptions of the service.

9. Personal data

FlirtIA collects only the data that is strictly necessary: an anonymous identifier, subscription status and error logs. Conversations stay on your device and are never stored on our servers; the text and images sent for generation are processed on the fly and then deleted. Data is hosted on European servers and is neither sold nor shared with third parties. You can delete your account and your data at any time. For more details, see our privacy policy.

10. Intellectual property

The FlirtIA service, its brand, its design and its content are protected by intellectual property law. The suggestions generated for you may be used freely in your personal conversations. Any reproduction or commercial exploitation of the service is prohibited without written authorization.

11. Changes to these terms

FlirtIA may modify these terms at any time, in particular if the service or the regulations change. Users will be informed of any substantial change. Continuing to use the service after notification constitutes acceptance of the new terms.

12. Governing law and disputes

These terms are governed by French law. In the event of a dispute, an amicable solution will be sought first. In accordance with the French Consumer Code, you may use a consumer mediator (médiateur de la consommation) free of charge. Failing that, the French courts will have jurisdiction.
